Florida Law 83.67 Prohbitied Practices Landlord/Tenant

Seven day notices and withholding rent

Seven Day Notice to my Landlord in Florida – My Landlord is not fixing things in my house!

Interesting news in St Petersburg, Florida about an alleged property scam that has potentially left unsuspecting renters as victims. Without going into the allegations, there were several landlord/tenant related issues that came up. These included a landlord allegedly not fixing items in the residence.

At Palmetto Law Group we frequently see tenants using methods outside the protections of Florida Statutes which gives tenants the ability to withhold rent or terminate the lease should proper notice be given to the landlord. Besides the landlord perhaps not being entitled to rent the property, the remaining two big issues for the renters in this story is did they give notice to the landlord prior to attempting to withhold rent and were the deficiencies within the house “material” violations?

When a tenant decides to give a seven day notice there are specific rules that a tenant must follow in order to legally withhold their rent or terminate their lease. We suggest contacting an attorney if you are having a serious issue with your landlord. If your landlord has been given notice or the issue just started, Palmetto Law, P.A. can assist.
